1. Agreement and legal identity
These Terms of Service govern access to and use of BossBack websites, accounts, trials, and services. By creating an account, starting a trial, purchasing a subscription, or using a BossBack service, you agree to these Terms.
“BossBack,” “we,” “us,” and “our” refer to Michael Madole carrying on business as BOSSBACK. “Customer,” “you,” and “your” refer to the business or person agreeing to these Terms.
2. Business use and authority
BossBack is intended for business use. You must be legally able to enter into a contract and, if you use BossBack for an organization, have authority to bind it. You are responsible for account users, credentials, and account security.
3. The BossBack service
BossBack provides practical AI capabilities for small businesses, including BossBack Answers and BossBack Sources. Other products may be described before becoming generally available. Features, limits, integrations, models, and service design may change as the product develops.
4. Beta services
BossBack Answers is currently a beta service. Beta services may contain defects, change frequently, and experience interruptions or limitations.
Beta does not remove our published privacy, security, and data-use commitments. It does mean you should evaluate whether the service is appropriate before relying on it for an important workflow.
5. Customer content and Sources
You retain ownership of business information, Sources, instructions, and other content you provide (“Customer Content”). You grant BossBack a limited, non-exclusive right to host, copy, transmit, transform, and otherwise process Customer Content only as reasonably necessary to provide, secure, support, and improve the service in accordance with these Terms and the Privacy Policy.
You represent that you have the rights and permissions needed to provide Customer Content. BossBack does not claim ownership of your business information.
6. Your website visitors
If you place BossBack on your website, you are responsible for your relationship with visitors and customers, including appropriate privacy notices, consent, and lawful use of conversation or lead information you receive.
7. AI-generated output
AI-generated content can be inaccurate, incomplete, or inappropriate even when BossBack is designed to use approved business information.
- Keep your Sources reasonably accurate and current.
- Review the configuration and monitor whether answers are appropriate.
- Do not treat BossBack as a substitute for professional judgment, diagnosis, legal advice, financial advice, medical advice, or other regulated expertise.
- Do not rely on BossBack as the sole basis for decisions materially affecting a person’s rights, health, safety, finances, employment, housing, credit, insurance, or legal position.
8. Acceptable use
You must use BossBack lawfully and follow the Acceptable Use Policy, which forms part of these Terms.
9. Trials, fees, billing, and taxes
Pricing, included usage, trial terms, and billing intervals are shown on the applicable pricing or checkout page. Unless otherwise stated, subscription fees are billed in advance. Where a trial does not require a payment method, paid billing will not begin unless you take the additional step required to start a paid subscription.
You are responsible for applicable taxes except taxes based on BossBack’s income. Pricing may change prospectively with notice before a change affects an existing paid subscription.
10. Cancellation and refunds
You may cancel a monthly subscription at any time. Unless a different offer is stated at purchase, cancellation takes effect at the end of the current paid billing period and does not create a prorated refund for unused time. Refunds required by applicable law will be provided.
After cancellation, active customer data may remain available for recovery for up to 30 days before deletion from active systems, subject to backups and legal retention requirements in the Privacy Policy.
11. Third-party services
BossBack relies on third-party services for hosting, network security, email, AI processing, and authentication. Payment processing providers may be added when paid billing is enabled. See Subprocessors. We are not responsible for independent third-party products or websites you choose to use outside BossBack.
12. BossBack intellectual property
BossBack and its licensors retain rights in the software, website, product design, documentation, trademarks, logos, and materials that are not Customer Content. The BOSSBACK mark is the subject of a pending Canadian trademark application. Subject to these Terms, you receive a limited, revocable, non-exclusive, non-transferable right to use the service for your business and to make approved customer-facing BossBack capabilities available on your website.
13. Availability, suspension, and termination
We do not guarantee uninterrupted or error-free operation. We may suspend or limit access when reasonably necessary to protect the service, investigate misuse, comply with law, address non-payment, or prevent harm. We may terminate an account for a material breach. Where practical and safe, we will provide notice and an opportunity to correct the issue.
14. Disclaimers
To the maximum extent permitted by law, BossBack is provided on an “as is” and “as available” basis. We do not warrant uninterrupted, error-free, perfectly secure, or universally suitable operation. AI output may contain errors. You remain responsible for decisions made by your business and for representations ultimately provided to customers.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
15. Limitation of liability
To the maximum extent permitted by law, neither BossBack nor the proprietor will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business interruption arising from the service.
To the maximum extent permitted by law, BossBack’s aggregate liability arising from the service during any 12-month period will not exceed the greater of (a) the amount you paid BossBack during the 12 months before the event giving rise to the claim, or (b) CA$100 if you have not paid BossBack.
16. Indemnity
To the extent permitted by law, you agree to defend and indemnify BossBack and the proprietor from third-party claims, losses, and reasonable costs arising from your unlawful use, Customer Content, violation of another person’s rights, or failure to provide legally required notices or permissions.
17. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Subject to any non-waivable right to another forum, disputes will be brought before the courts of Ontario, Canada.
18. Changes
We may update these Terms as the service changes. For material changes affecting an existing paid customer, we will provide reasonable notice before the change takes effect where practicable. Continued use after the effective date constitutes acceptance of the revised Terms.
